A burrito is not a sandwich. Well, of course it’s not. You would never put sour cream and salsa on a sandwich, but the courts were forced to decide if a burrito was in fact sandwich. It started when Mexican eatery Qdoba signed a lease to open a restaurant in a strip mall. A fellow tenant of the mall, Panera bread, asserted they had a sandwich clause in their lease which gave them exclusive rights to sell sandwiches on the property.
Panera claimed that a sandwich is meat, cheese and fillings between bread and the challenge was on. The case was signed to Judge Jeffrey Locke, who turned to the most essential of all legal texts. Webster’s Dictionary, before reaching his conclusion that a burrito is not a sandwich. He wrote that a sandwich is not commonly understood to conclude burritos, tacos, quesadillas which are typically made with a single tortilla and stuffed with a choice filling of meat, rice, and beans.
